IVC Filters

IVC Filters – Migration & Perforation

IVC (inferior vena cava) filters are small, metal devices designed to stop a blood clot from traveling to the lungs. There are two types of IVC blood clot filters: retrievable and permanent.

Possible Personal Injury: Migration and Perforation

Unfortunately, IVC filters can fracture or break apart in the vein, puncture the vein walls, migrate into the heart, or fail to stop blood clots from bypassing the device. Personal injury lawsuits allege that the manufacturers failed to adequately warn doctors and patients about the adverse side effects. If you or a loved one experience adverse side effects from an IVC filter, you may be entitled to compensation, and Beacon Legal Group (BLG) personal injury attorneys stand ready to assist you.

History of the IVC filter

The device was introduced in 1979, and its use increased through the years. In a report released in 2010, the FDA received more than 900 reports of adverse events associated with IVC filters, including 70 filter perforations, 328 device migrations, 56 filter fractures, and 146 embolisms. By 2012, doctors inserted approximately 259,000 filters in patients. Today more than 2,000,000 IVC filters have been inserted into patients.

Case Status

As of July 2018, there were more than 8,000 personal injury lawsuits against two IVC filter makers. The major defendants are the manufacturers Bard, Cook, and Cordis J&J. In May and April of 2018, injured plaintiffs won $1.2 million and $3.5 million. Very important to the resolution of these cases is the fact that $2 million of the damages were punitive to punish C.R. Bard for their conduct.  Why is this so significant?  It shows that the jury was angry and did not feel C.R. Bard was just a company that made an honest mistake. This jury-directed punitive damage increases the settlement value all of the other IVC lawsuits out there.
